Your information and photos will not be shared with anyone and will only be used for processing your orders. We will always request your permission before posting any of your photos on the Internet as examples of the work we provide.

Designer Photo Imaging (DPI) will not sell, rent or trade the personal information you provide online. We will not send users of DPI any promotional marketing materials or newsletters. The only e-mail communication a user receives is in response to your inquires or questions about the job.

DPI may disclose personal information to third parties without your consent for any of the following reasons: to comply with any law, regulation to court order; to cooperate with government investigations; or to enforce or protect the rights of DPI.

DPI may contain links to and from other websites and is not responsible for the privacy practices of those websites. DPI encourages you to read through the privacy practices of those websites.

TERMS & CONDITIONS

Before using Designer Photo Imaging's ("DPI's") services you must agree to the terms and conditions stated below. By using DPI's services, you are agreeing to the terms and conditions stated below. If you do not agree you will not be permitted use.

You agree to use the site only for lawful purposes. You agree not to take any action that might compromise the security of the site, render the site inaccessible to others, or otherwise cause damage to the site or the content. You agree not to add to, subtract from, or otherwise modify the content, or attempt to access any content that is not intended for you. You agree not to use the site in any manner that might interfere with the rights of third parties. You understand and agree that you are personally responsible for your behavior on the site. DPI will decide whether you've breached any of the above restrictions.

We have the right to refuse service we believe to be illegal, breach our terms & conditions, violate the rights of any third party or are otherwise objectionable to us. We are not liable for not fulfilling such orders.

LIABILITY

Other than the Guarantee below, DPI makes no express or implied warranties, representations or endorsements whatsoever with respect to the site, the service or the content. DPI is not liable for any damages due to failure to make edits to photos, delays in producing the final product or any technical problems, which include loss & destruction of photos. Our liability is limited to the cost of the image editing services only. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, some of the above limitations may not apply to you. In such states, DPI's liability is limited and warranties are excluded to the greatest extent permitted by law, but shall, in no event, exceed $100.

You are solely responsible for keeping back-up copies of your original images; never send DPI the original photographs for which there are no other copies or negatives. If you must send originals it is the responsibility of the customer to make sure the prints sent to and from them do not get damaged or lost. DPI currently maintains client files in our system for one year after your order is complete. DPI reserves the right to change this file management policy at any time. Additional prints may be purchased for any client files still in DPI's possession for the current price listed at the time of the new order.

DPI may modify or discontinue any services without notice; we are not liable for any modifications to the services.

We will do our best to deliver your order within the time stated for the service. All time periods are estimates, refer to working days and do not include weekends (Saturdays & Sundays). We accept no liability for loss or damage suffered due to late delivery or non-delivery caused by a third party. Note that all pricing listed is per photo unless otherwise noted.

GUARANTEE

Through our order process you are guaranteed that we complete your work first, before you pay anything. Then you pay only when you are happy with the final digital proof. Our goal is to produce consistent high-quality results according to each customer's order specifications. The quality of any prints we produce is dependent upon the quality of the original print, negative, print or digital file sent to us. We are not required to redo orders that are unsatisfactory as a result of the quality of the original print, negative, or file, or the customer's failure to include clear and complete instructions. If we fail to perform clearly communicated instructions, we will redo the image at no additional charge. If additional instructions are received after our quote and/or proof has been submitted, we may find it necessary to increase the quoted price to cover the increased work required. Credits or refunds will not be issued once the proof has been approved and the customer has paid for our services unless we determine, at our sole discretion, that we were unable to complete the work in accordance with the customer's instructions. This policy is required because of the distinctly subjective element to digital image editing. Once we deliver edited images to the customer, it is impossible to prevent a customer from using them or making copies.

Under Federal copyright law, it is illegal for people to reproduce images and photographs unless they own the copyright or are authorized by the copyright owner. The copyright owner is the person who created the image or took the photograph. By submitting an image or photograph to DPI for service, you are representing that 1) you are either the owner of the image/photograph or have the owner's permission to use/edit/reproduce the image/photograph; and 2) that you as the owner or with the owner's permission grant permission for DPI to use/edit/reproduce the images. You are solely responsible for any copyright violations that may occur as a result of your activities or use of services provided by DPI, and will indemnify and hold DPI harmless for same.

The Designer Photo Imaging name and logo are trademarks or service marks of Designer Photo Imaging. You are prohibited from using any of the marks or logos appearing throughout the site without permission from the trademark owner, except as permitted by applicable law.

*I (the user/customer of DPI) certify that I am the copyright holder or have permission from the original photographer & reserve the right to legally submit the following photo(s) to Designer Photo Imaging. I have read through and agree with all of the Terms & Conditions of DPI and will abide by their rules & regulations.
